Terms & Conditions of Contract

Please read these terms carefully before using our services

Agreement to Terms

These Terms & Conditions of Contract ("Terms") form part of the agreement between you (the "Customer") and Volunteer Decks LLC ("Volunteer Decks," "we," "us," or "our") for deck construction, repair, and related services in the Knoxville, Tennessee area.

By signing your estimate, contract, or work order, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply alongside any written contract, estimate, or work order you sign with us.

TIMELINES

1. Project Timelines, Delays & Estimates

Business Days

All project timeframes and schedules are based on standard business days (Monday through Friday). Weekends and recognized public holidays are considered non-working days and do not count toward promised timeframes or project duration estimates.

Estimated Dates

All start and completion dates are good-faith estimates. Volunteer Decks will make every reasonable effort to meet these dates; however, we are not liable for delays beyond our control.

Remote Estimates

Estimates based solely on measurements, photos, and information provided by the Customer are subject to change. If an on-site inspection reveals inaccuracies in the provided information or differing site conditions, Volunteer Decks reserves the right to adjust the final quote and scope of work accordingly.

Debris Removal

The demolition, hauling away, and disposal of existing structures or construction debris are only included in the project if explicitly outlined in the agreed-upon estimate.

Excusable Delays

Volunteer Decks is not responsible or financially liable for project delays caused by severe weather, acts of God, material shortages, supply chain disruptions, delayed municipal or county inspections, or changes requested by the Customer.

CANCELLATION

2. Cancellation Policy

Standard Right to Cancel

The Customer may cancel this agreement without penalty within three (3) business days of signing the initial contract, provided work has not commenced and materials have not been delivered.

Notice of Cancellation

Notice of cancellation must be provided in writing. The Customer must give notice by a method that allows proof of delivery, including registered mail, fax, or personal delivery.

Extended Cancellation Rights

If the Customer does not receive the goods or services within 30 days of the date stated in the contract, the Customer may cancel this contract within one year of the contract date. This right is forfeited if delivery is accepted after the 30 days. The Customer may contact their state consumer affairs office for more information on extended cancellation grounds. If canceled under these terms, Volunteer Decks has 15 days to refund the money and any trade-in value, after which the Customer must return the goods.

Late Cancellation

If the Customer cancels this contract after the three-day grace period, Volunteer Decks reserves the right to retain the initial deposit to cover incurred administrative costs, scheduling losses, and material deposits.

Materials & Restocking

If materials have already been ordered, fabricated, or delivered prior to a late cancellation, the Customer is entirely responsible for the cost of all custom or non-returnable materials, plus any applicable restocking fees or return shipping costs for returnable items.

Contractor Termination

Volunteer Decks reserves the right to terminate this contract due to customer non-payment, breach of contract, unsafe site conditions, or a hostile work environment.

CHANGE ORDERS

3. Unforeseen Conditions & Change Orders

Hidden Damage & Minor Repairs

Estimates do not include the repair of hidden or concealed damage. If wood rot, termite damage, water damage, or structural compromises are discovered during demolition or construction (e.g., rotted rim joists, ledger boards, or siding behind the existing deck), Volunteer Decks reserves the right to replace necessary material and bill the Customer up to $200 in addition to the estimated cost without advance notice.

Hazardous Materials

If hazardous materials (including but not limited to lead-based paint or asbestos) are discovered during demolition or construction, Volunteer Decks will immediately halt work in the affected area. The Customer is solely responsible for the cost and coordination of professional abatement and remediation before Volunteer Decks can safely resume the project.

Change Orders

For any necessary repairs exceeding $200, or any deviations/alterations from the original scope of work requested by the Customer, Volunteer Decks will halt work in the affected area and notify the Customer immediately. A written Change Order outlining the additional costs must be approved by the Customer before the extra work commences.

PAYMENT

4. Payment Terms & Default

Deposit & Final Payment

A 30% deposit is due upon signing the contract. The remaining balance is due in full immediately upon substantial completion of the project and the final walkthrough.

Credit Approval

Approval of the estimate is subject to customer credit approval by Volunteer Decks. The Customer agrees that Volunteer Decks may access credit bureau reports, trade references, and other credit information prior to granting credit approval.

Late Payments

Any balance remaining unpaid after 15 days of the invoice date will be subject to a late fee of 1.5% per month (18% annually) or the maximum amount permitted by law.

Insurance Claims

Any insurance claims are subject to the specific terms and conditions outlined by the Customer's insurance company and may be subject to insurance company approval.

Material Quantities

The Customer is not responsible for material shortages and has no claim to material surpluses remaining after the job is complete.

Work Stoppage

Volunteer Decks reserves the right to halt construction and pull crews from the job site if progress payments are not made as agreed, without penalty for the resulting project delay.

SITE ACCESS

5. Site Access & Property Conditions

Property Ownership

The Customer certifies that they are the registered owner of the project property or have the legal permission to authorize Volunteer Decks to perform the work as stated and agree to pay the total project price.

Permits & HOA Approvals

Volunteer Decks is responsible for obtaining standard municipal building permits required for the project. However, the Customer is solely responsible for obtaining any necessary approvals, variances, or permissions from their Homeowners Association (HOA) or historic neighborhood commission prior to the start of construction.

Access & Utilities

The Customer agrees to provide reasonable access to the work site, as well as access to standard electricity and water required to complete the construction.

Property Protection

While Volunteer Decks takes every precaution to protect the Customer's property, we are not liable for minor, unavoidable damage to landscaping, grass, or driveway surfaces resulting from foot traffic, heavy equipment, material delivery, or dumpsters.

Exterior Cosmetic Damage

Minor damage to siding, brick, or stucco may result when the old structure is removed or when properly flashing the new structure to the home. Volunteer Decks is not liable for minor cosmetic repairs to siding or stucco where it meets the deck ledger.

Personal Items & Pets

The Customer is responsible for relocating any fragile interior items from walls that may fall or be damaged due to vibrations from demolition, ledger board installation, or general construction. Volunteer Decks is not liable for such damages inside the home. Pets must be secured indoors or away from the active construction zone for the duration of the project.

Underground Utilities

Volunteer Decks is not responsible for damage to hidden underground utilities (e.g., sprinkler lines, invisible fences) unless they were explicitly marked by the Customer prior to the project start date.

SAFETY & LIABILITY

6. Job Site Safety & Liability

Active Work Zones

For the safety of everyone involved, the Customer, their family members, guests, and pets must maintain a safe distance from the active work zone while crews are actively working or operating heavy machinery on the property.

Unauthorized Access

The construction area—including any partially completed framing, decking, stairs, or trenches—is strictly off-limits to the Customer at all times until the project is deemed 100% complete and the final walkthrough has been conducted. An unfinished deck is a hazardous environment, and walking on unfastened boards or incomplete structures poses severe safety risks.

Release of Liability

Volunteer Decks assumes no legal or financial liability for any injuries sustained by the Customer, their family members, guests, or pets resulting from unauthorized entry into the active construction zone, tampering with tools or equipment, or stepping onto incomplete structures prior to final project handover.

Interference

If the Customer consistently interrupts the crew, enters the active work zone, or creates an unsafe/hostile environment, Volunteer Decks reserves the right to halt work until a safe working perimeter can be established and agreed upon.

WARRANTY

7. Workmanship Warranty

This document provides a warranty on workmanship related to the work completed by Volunteer Decks. If a defect in workmanship occurs within the timeframes listed below, Volunteer Decks will complete repairs within the original project's scope of work at no charge to the Customer:

  • Composite / PVC Decks & Porch Structures: 5 years from the project completion date.
  • Natural Wood Decks: 1 year from the project completion date.
  • Roof Systems: 1 year from the project completion date.
WARRANTY LIMITATIONS

8. Warranty Exclusions & Limitations

General Exclusions

This warranty does not cover normal wear and tear, hail damage, wind damage, sun damage (fading), intentional or accidental damage by any person, or acts of God that may or may not merit an insurance claim. For roof systems, this warranty does not cover leaks caused by ice dams, gutter overflow due to lack of maintenance, or wind-driven rain exceeding manufacturer specifications.

Maintenance Items

This agreement and associated warranties do not apply to regular maintenance items (e.g., sealants, stains), which will deteriorate over time and must be inspected and maintained by the Customer on a regular basis.

Natural Wood Disclaimer

For projects utilizing natural wood (pressure-treated pine, cedar, framing lumber, etc.), this warranty does not cover the natural characteristics of the material. Specifically, as the wood goes through its natural drying process and releases moisture, it is highly prone to shrinking, bowing, warping, twisting, splitting, and checking (cracking). These reactions are inherent properties of natural wood adjusting to the environment and are not considered defects in material or workmanship.

Scope of Warranty

This warranty only applies to portions of the project in which Volunteer Decks fully replaced or installed the product, and does not cover partial repairs or service done to another contractor's work or existing home structures.

Material Warranties

Defects in the building materials themselves do not fall under the scope of this workmanship warranty; any building products installed (such as composite decking, railing systems, lighting, shingles, or metal roofing) will instead be covered by the product's original manufacturer warranty (e.g., Trex, TimberTech, Deckorators). Full warranty details are available by request.

PROMOTIONAL USE

9. Promotional Use

Photography

Volunteer Decks reserves the right to take photographs and video of the project before, during, and after construction. The Customer grants permission for these images to be used for marketing, social media, and portfolio purposes. No identifying information or specific addresses will be publicized.

COMMUNICATIONS

10. Communications and SMS Terms

Consent to Communications

By providing your contact information, you consent to receive communications from us via email, SMS text messages, and phone calls regarding your inquiry, quotes, project updates, and occasional marketing messages.

SMS Messaging Terms

  • Message frequency varies based on your project and preferences
  • Message and data rates may apply from your carrier
  • Reply STOP to any message to opt out of SMS communications
  • Reply HELP for assistance or contact us directly
  • We do not charge for SMS messages, but your carrier's rates apply

Opting Out

You may opt out of marketing communications at any time by replying STOP to SMS messages, clicking unsubscribe in emails, or contacting us directly. Opting out of marketing communications will not affect transactional messages related to active projects.

DISPUTES

11. Dispute Resolution & Governing Law

Informal Resolution

We are committed to resolving any disputes amicably. If you have a concern or complaint, please contact us directly so we can work together to find a solution.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Knox County, Tennessee, and you consent to the jurisdiction of such courts.
